Adoption Contract

It is of our preference for all our mommies to be 8 lbs and up. This is due to the fact our larger girls do not have problems and are healthier. If you are wanting the so called teacup we cannot accommodate this as this is an unhealthy baby in our humble opinion.

A pet PUPPY is defined here to be a Biewer or Yorkshire Terrier puppy which is in good health at the time of sale, and embodies the characteristics of theBiewer or Yorkshire Terrier breed . This PUPPY is purebred and is register able (registered) with AKC or IBC in Germany.

This PUPPY is registered with a limited registration,unless otherwise stated, which will prohibit breeding and registering offspring. (The BUYER agrees the PUPPY is to be spayed at the appropriate age, and veterinarian confirmation of this must be supplied to the BREEDER.)

The BREEDER guarantees the above described dog to be healthy at the time of the sale.

The BREEDER does not guarantee the size or color of said Puppy.

The BREEDER does not assume any liability for any injury to said puppy after delivery.

The Buyer understands that the shipping cost, Shipping Crate, Vet exams are separate from the actual cost of said Puppy

The BUYER agrees to have this puppy examined by a veterinarian within 72 hours of delivery.

If the puppy is found to be other than healthy by the BUYER'S veterinarian, it shall be returned to the BREEDER immediately, and the Puppy will be replaced with an equivalent puppy. Deadline for this refund is __72 Hours from date of sale Never at anytime will money be refunded this will be for replacement puppy when one becomes available.

All appropriate shots for the PUPPY'S age have been given, and a record of this vaccination history is supplied.

The BUYER agrees to maintain the puppy's health in good condition, and to provide yearly examinations, vaccinations, heartworm test, and any other usual procedures necessary to assure good health.

The BREEDER has done everything possible to produce healthy sound puppies both by breeding only dogs (parents) that are certified free of hip and elbow dysplasia, (add any other appropriate testing for the breed in question) and by raising the puppies in the best way possible in regards to diet, exercise, socialization and veterinary care.

There are many factors that can influence growth and development, such as diet, exercise, weight gain, etc.. The BUYER assumes the responsibility to carry on with the appropriate vaccinations, exercise and feeding schedule, as supplied by the BREEDER. MOST PARTICULARLY, the BUYER agrees to keep the puppy slim throughout it's normal growth period. The BREEDER can offer no further guarantees once the care of the puppy is no longer under their control.

The BUYER agrees that neither he/she nor the BUYER'S estate/executors may sell this PUPPY or transfer ownership of this PUPPY without the BREEDER'S knowledge and written consent

The BUYER hereby agrees that if at any time the Buyer cannot take proper care of the puppy, the BUYER must contact the BREEDER and the BREEDER will have the first choice to either: (a) take the PUPPY back or (b) assist the BUYER in finding a suitable home for the PUPPY.

The BUYER agrees to notify the BREEDER of any changes of address during the PUPPY'S lifetime.

The Buyer agrees to provide a suitable fenced area for this puppy.

The BREEDER neither makes or implies any warranties or guarantees, express or implied, other than those written in the agreement including, without limitation, the warranties of merchantability and fitness. This document constitutes the entire agreement between the Breeder and Buyer with respect to this sale. The Buyer's signature below indicates that he/she has read, agrees and does understands all the conditions of the Sales Agreement and Contract of Sale. In the event of legal matters it will be conducted in the courts of Grayson County Sherman,TX

Breach of Contract

This comes into affect when either party refuses, declines or deliberately breaks any of the terms set forth in this contract. If any condition or term is broken by buyer then seller will not delay in taking the appropriate steps to rectify the situation. In the event a breach of contract occurs and court proceedings must be taken then they will be held in Sellers State of residence. If however seller is made to travel to Buyers State of residence then buyer is responsible for all of sellers expenses including, but not limited to court costs, travel expenses and lost wages. All efforts will be made by seller to prosecute to the fullest extent of the law. Buyer shall also pay any expenses incurred when seller has to travel to reclaim a dog due to breach of contract. In the event that pup/dog is injured or killed due to a breach of contract condition then the sum of the value of the pup/dog plus any other expenses is due to seller. In the event that sellers name is defamed or slandered stemming from buyers breach of contract then seller will pursue legal action and ask for liquidated damages and any expenses incurred including, but not limited to travel costs, court fees and lost wages.


Sellers Rights of Limitations

Seller will not be responsible for any dog bite; attack or mauling resulting from sold pup/dog. Any and all liabilities stemming from this are the sole responsibility of buyer and no charges or judgments will be made against seller.

By signing all parties involved with the sale and purchase of pup/dog have agreed they have read agree to and understand the terms and conditions of this contract. If there are any question from either party they need to be addressed before the signing of the contract. This contract becomes legally binding once all signatures required have been signed to this contract.

Our Health Contract

RooBear Yorkies & Biewers
HEALTH GUARANTEE

Your Roobear baby is fully guaranteed against congenital defects, and is in sound health and free from communicable diseases at the time of this placement to the best of our knowledge and belief.

Two - Month
If your Roobear baby dies or is crippled by Distemper, Hepatitis or Leptospirosis within two months after placement, notify the kennel immediately, return the Registration papers to the kennel along with a written veterinary statement stating the nature of the demise, and we will replace the dog with another puppy at 50% as soon as one becomes available.

If your Roobear baby dies from Parvovirus after placement notify the kennel immediately, return the registration papers and written veterinary and laboratory verification stating the nature of the demise to the kennel. We will replace the dog with another puppy at 50% as soon as one becomes available.

Ten-YEAR CONGENITAL HEALTH DEFECT GUARANTEE

If your Roobear baby develops a condition that dates from the prenatal or fetus stages, notify the kennel immediately, return the registration papers and written veterinary verification from your vet stating the defect or condition to the kennel. We will replace the dog with another puppy at no charge as soon as one becomes available. This is to include Liver Shunt

TWO-YEAR HIP,Knee AND ELBOW GUARANTEE

If at any time during the two (2) year hip/elbow guarantee period of a Roobear baby, he is found crippled from Hip or Elbow Dysplasia, notify the kennel immediately. Return the registration papers, spay or neuter certificate, written veterinary verification and X- Rays, and the dog will be replaced with another at no charge as soon as one becomes available.

Ten-Year TEMPERAMENT GUARANTEE

If at any time during the lifetime of a Roobear baby, he is found not to be compatible with the purpose he was intended AND directly related to temperament, notify the kennel, return the dog and the registration papers to the kennel, along with a written statement from a certified trainer with “reason for return.” We will replace the dog with another puppy at no charge as soon as one becomes available. This does not apply to behavioral issues due to improper training or socializing of the dog. No cash refunds in whole or part. Enrollment and successful completion of training classes are a condition of sale and for free replacement puppy.

Ten-Year Accident or Loss

At any time should your Roobear baby becomes involved in an accident or stolen we will offer you another baby at 50% of the original price and equivalent baby.

LIMITATIONS OF ALL GUARANTEES

These guarantees apply to the original dog only and are non-transferable. Should the dog be in need of immediate veterinary treatment of a covered illness, the kennel must be notified at once, and all possible humane measures to treat the dog are attempted or no replacement will be given.
It is common for toy breeds have to have  puppy teeth removed, there is no guarantee for this nor will RooBear Yorkies pay for this expense.
Follow-up routine vaccinations and de-worming must be given at 12, and 16 weeks of age as outlined in your “Follow-Up Care” and be administered by a licensed veterinarian throughout the full health guarantee period (two years from date of placement). “Proof” must be available. The enrollment and successful completion of training classes are a condition of sale .Returned dogs must be shipped prepaid. No cash refunds. Owners are responsible for transportation costs to and from the kennel. Our sincere hope is that you and your dog experience a long and lasting bond.

In the event of litigation, this will be handled through the courts in Grayson County, Sherman, Texas

RooBear Yorkies & Biewers will not at anytime refund money nor be responsible for medical bills. All medical attention is the responsibility of the buyer and RooBear Yorkies & Biewers will only provide a replacement puppy when one becomes available.


The buyer is advised to have this puppy examined by a competent veterinarian of the buyers'

choice within 3 working days to assure them that they have purchased a healthy puppy. This

will be done at the purchaser's expense. Under no circumstances will RooBear Yorkies & Biewers be

responsible for any veterinarian bills acquired by the purchaser for this puppy. Minor, breed

related, treatable or correctable conditions, or any condition that may go away or is considered

to be a condition which a puppy will likely outgrow, are not covered.

RooBear Yorkies & Biewers, DOES NOT GIVE REFUNDS. We will give a replacement puppy, but only for

life threatening genetic disease.

(1) A written explanation from a licensed veterinarian and backed up with lab work or x-rays

as to the nature of the problem.

(2) A second opinion from a Vet whom RooBear Yorkies & Biewers have approved in advance to

examine the puppy for signs of abuse or for life threatening congenital defect.

(3) Return the puppy and AKC/IBC papers to us at buyers expense. If you are unwilling to

release the puppy and AKC/IBC papers into my possession, I will not be responsible for any

medical expenses incurred nor will I be a part of the recovery process.

(4) Proof that the puppy was examined by a certified veterinarian no later than 3 working days

after receiving the puppy.

If the Vet's prognosis is that of the puppy has a life threatening genetic disease and all of the

above criteria are met, we will replace a puppy of equal value when one comes available.

No problems other than life threatening congenital defects are covered in this agreement.

RooBear Yorkies & Biewers offer this guarantee until the puppy reaches ten years of age.

If at any time you transfer ownership of the puppy, this agreement is void immediately.



RooBear Yorkies is not responsible for the health of this Puppy after the 72 hour period.

RooBear Yorkies cannot guarantee that any male Puppy sold will have two testicles.
RooBear Yorkies will grant all its dogs with full breeding rights unless otherwise specified.
If the dog is unable to breed for any reason RooBear Yorkies is not responsible and cannot
guarantee the fertility of a male or female puppy. A show quality puppy is sold as such based
on buyers best judgment at the time of sale. RooBear Yorkies cannot guarantee the

continued development of the individual Puppy's show potential.



I understand that this puppy can NEVER be turned in at a shelter, rescue organization or
unqualified home and if circumstances require a new home for my puppy, buyer will contact
Seller so Seller can provide assistance in finding a secure and safe home.
